1. Agreement to Terms
By accessing or using FairwayPass ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
FairwayPass is operated via the Polsia platform. These Terms constitute a legally binding agreement between you and FairwayPass.
2. Description of Service
FairwayPass is a golf membership platform that provides:
- Discounted access to partner golf courses across Denmark and Scandinavia
- Booking management for tee times at member pricing
- Course discovery and recommendations based on your preferences
- Membership tiers (Free and Premium) with varying access levels
FairwayPass acts as an intermediary between members and partner golf courses. We do not own or operate golf courses.
3. Account Creation & Eligibility
To use FairwayPass, you must:
- Be at least 16 years old
- Provide accurate, complete, and current account information (name, email address)
- Maintain the security of your password
- Accept responsibility for all activity under your account
You may not create multiple accounts to abuse free trial benefits or circumvent membership restrictions.
4. Membership Tiers
4.1 Free Membership
- Cost: Free
- Access: Browse courses, view discounts, limited booking features
4.2 Premium Membership
- Cost: €9/month (or local currency equivalent, e.g., 69 DKK/month)
- Billing: Automatically charged monthly via Stripe until you cancel
- Access: Full member pricing on green fees (up to 50% off), priority booking, personalized recommendations
5. Payment Terms
5.1 Subscription Billing
- Premium membership is billed monthly on the same date you signed up
- Payments are processed securely via Stripe
- All prices are in EUR (or local currency equivalent) and include applicable taxes
- If a payment fails, we'll notify you via email. Your account may be downgraded to Free after 7 days of failed payment
5.2 Refunds
- Membership fees: Non-refundable. If you cancel mid-month, you retain access until the end of your billing period
- Green fees (course payments): Refund eligibility depends on the specific course's cancellation policy. Contact fairwaypass@polsia.app for assistance
6. Cancellation Policy
You may cancel your Premium membership at any time:
Upon cancellation:
- You will not be charged again
- You retain Premium access until the end of your current billing period
- After that, your account reverts to Free membership (you do NOT lose your account or booking history)
7. Acceptable Use
You agree to use FairwayPass responsibly. You may NOT:
- Abuse bookings: Make fake bookings, no-show repeatedly, or resell tee times for profit
- Violate course policies: Harass staff, damage property, or behave inappropriately at partner courses
- Hack or exploit: Attempt to reverse-engineer, scrape, or manipulate the platform
- Create multiple accounts: To abuse free trials or membership benefits
- Share accounts: Your FairwayPass account is for personal use only
Violations may result in account suspension or termination without refund.
8. Partner Course Relationships
FairwayPass partners with golf courses to offer member pricing. However:
- We do not control course operations, conditions, or availability
- Partner courses may change pricing, availability, or terms at any time
- Disputes with courses (e.g., service quality, cancellations) should be resolved directly with the course. We'll assist where possible, but we are not liable for course actions
9. Booking Terms
- Booking confirmation: Once you book a tee time, you'll receive a confirmation email. Bring this confirmation (or your FairwayPass membership details) to the course
- Cancellations: Cancellation policies vary by course. Check the course details before booking
- No-shows: Repeated no-shows may result in booking restrictions or account suspension
10. Intellectual Property
All content on FairwayPass (logos, text, images, design) is owned by FairwayPass or licensed to us. You may not:
- Copy, reproduce, or distribute our content without permission
- Use our brand name or logo without written consent
11. Disclaimers & Limitation of Liability
FairwayPass is provided "as is" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free service
- Accuracy of course information (pricing, availability, descriptions)
- Specific savings amounts (discounts vary by course and time)
Limitation of Liability: To the fullest extent permitted by EU/Danish law, FairwayPass is not liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Issues caused by partner courses (e.g., course closures, weather, service quality)
Our total liability to you is limited to the amount you paid for your membership in the past 12 months.
12. Indemnification
You agree to indemnify and hold FairwayPass harmless from any claims, damages, or legal costs arising from:
- Your violation of these Terms
- Your misuse of the Service
- Your conduct at partner golf courses
13. Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent or abusive behavior
- We discontinue the Service (with 30 days' notice)
Upon termination, you lose access to Premium features and may forfeit unused membership time (no refunds).
14. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Significant changes will be communicated via email.
Continued use of FairwayPass after changes are posted constitutes acceptance of the new Terms.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of Denmark and the European Union. Any disputes will be resolved in Danish courts.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect.
